Understanding Personal Injury Protection and Tort Threshold in Single-Vehicle Accidents

As a no-fault state, Massachusetts requires that certain insurance coverages must be sold with every car insurance policy, known as personal injury protection benefits (PIP). This added coverage covers up to $8,000 for medical expenses for injuries sustained in a single-vehicle car accident, as well as up to 75% of lost wages, as long as benefits have not been exhausted.

In addition to PIP benefits, you must also consider the Massachusetts tort threshold as it pertains to claiming compensatory damages in a vehicle accident. In order to be eligible to seek compensation from the liable party for medical losses, you must show bills totaling more than $2,000 in damages.

There are a few exceptions to the tort threshold, including:

  • Loss of a body part
  • Permanent and severe scarring or disfigurement
  • Vision or hearing loss
  • Fractures, such as broken teeth
  • Death

At Sweeney Merrigan Personal Injury Lawyers, we review all aspects of your case and determine the value of your claim. We fight for the maximum, fair compensation you deserve if you have sustained significant injuries due to someone else’s negligence in a single-vehicle accident.

Determining Liability in a Single-Vehicle Accident in Massachusetts

In Massachusetts, you must meet certain requirements in order to qualify to pursue liability in a single-vehicle accident claim. The following must be met for a successful car accident claim:

  • The careless driver is more than 50% at-fault per the Massachusetts Standards of Fault
  • The liable party operated a private vehicle
  • The damage is more than $500 over any insurance deductible
  • The claim is specifically for bodily injury to others, collision, property damage, or limited collision

Speak with an experienced Boston single-vehicle car accident attorney at Sweeney Merrigan Personal Injury Lawyers for skilled legal guidance and help with conducting the necessary investigations to determine liability in the accident. We understand the necessary elements required to build a strategic case and fiercely advocate for the compensation you deserve.

Modified Comparative Negligence

If the other party was wholly responsible for your single-vehicle accident, they may be liable for losses, such as costly medical expenses, lost wages, and other losses you’ve suffered that are paid through their insurance provider.

However, if you share some of the blame for the accident, Massachusetts statute Chapter 231 Section 85 dictates that the liable party’s award may be reduced to the percentage equal to their share of fault, given that the percentage is 50% or less. If fault exceeds 50%, then the liable party is not entitled to an award.

How to Establish Liability in a Single-Vehicle Accident in Massachusetts

If you were harmed in a single-vehicle accident, you may feel overwhelmed with what to do next since no other driver hit you. Retaining an experienced Boston car accident attorney at Sweeney Merrigan Personal Injury Lawyers will help prove the presence of negligence that may have caused the accident through extensive investigations, obtaining witness testimony, or determining whether there was a car part defect or malfunction.

In a situation in which a liable driver is proven to have exhibited negligent driving behaviors such as swerving, failing to signal, or using a phone while driving, you may be able to recover necessary compensation for the losses you endured due to their careless actions. We work to build a strategic case on your behalf to ensure you obtain the justice you deserve.

If a driver who caused your single-vehicle accident is not identified, you may be able to file an uninsured vehicle claim with your own insurance provider. In order to protect your best interests, work with a skilled Boston single-vehicle accident lawyer to negotiate on your behalf with insurance adjusters and protect your legal rights.
